Limited warranty terms Berfon SRL

      Berfon SRL’ (hereinafter Seller) warrants the AIR³ (Product) against defects in materials and workmanship for one (1) year from date of purchase (date of invoice), limited to the terms set forth below.

      This warranty does not limit the user’s rights under any applicable national laws relating to the sale of consumer products.

      ORIGINAL PURCHASE ONLY

      The Seller’s warranties extend to authorized dealers only.  No warranty offered by Seller is transferable.  Seller specifically disclaims any warranty to any party who did not directly purchase from Seller or an authorized dealer. This limited warranty is not transferable to subsequent purchasers or owners of this Product.

      WARRANTY COVERS NORMAL USE ONLY AND EXCLUDES DEFECTS DUE TO EXTERNAL CAUSE

      Seller Warranties cover defects arising under normal use only and do not include malfunctions or failures resulting from usage. No warranty shall apply if the product has been submerged in fluids, dismantled or altered by a shock or any other external cause.

      LIMITATIONS OF COVERAGE

      This limited warranty does not cover any damage, deterioration or malfunction resulting from any alteration, modification, improper or unreasonable use or maintenance, misuse, abuse, accident, neglect, exposure to excess moisture, fire, improper packing and shipping (such claims must be presented to the carrier), lightning, power surges, or other acts of nature. This limited warranty does not cover any damage, deterioration or malfunction resulting from any unauthorized tampering with this Product, any repairs attempted by anyone unauthorized by Seller to make such repairs, or any other cause which does not relate directly to a defect in materials and/or workmanship of this Product. This limited warranty does not cover cartons, equipment enclosures, cables or accessories used in conjunction with this Product. Without limiting any other exclusion herein, Seller does not warrant that the Product covered hereby, including, without limitation, the technology and/or integrated circuit(s) included in the Product, will not become obsolete or that such items are or will remain compatible with any other product or technology with which the Product may be used.

      In addition or for clarification, Warranty does not cover

      (i) Damage, fault or failure related to the screen/display and/or batteries.

       (ii) Damage, fault or failure resulting from software, virus(es).

      (iii) Damage, fault or failure due to improper transportation, delivery, unpacking, inappropriate storage conditions or materials, improper ventilation, reconfiguration of the Product, movement of the Product.

      (iv) Damage, fault or failure due to corrosion or power surge.

       (v) Any utilization of Product that is inconsistent with either the design of the Product or the way the Seller intended the Product to be used.

      (vi) Normal wear and tear and cosmetic damage such as, but not limited to corrosion, scratches, dents, rust, stains. Non-functional parts such as, but not limited to, plastics and finishes.

      WARRANTY REQUIREMENTS


      - Warranty coverage requires proof of purchase documentation (invoice or packing slip).
      - RMA number: Return Merchandise Authorisation. Any return requires an authorisation provided by the Seller.

      - All returns must be clearly marked with the RMA number on the outside of the package for identification.
      - Returns will not be accepted unless so marked, clearly marked as defective with no value for customs clearance.
      - Goods must be returned properly packaged in their original shipping container or in an equivalent, to ensure that they are not damaged in transit.

      NO MODIFICATION OF WARRANTY

      No Seller’s reseller, agent, or employee is authorized to make any modification, extension, or addition to any warranty.

      WHO MAKES THE DETERMINATION OF CAUSE?

      Seller shall make the final determination as to the existence and cause of any defect.

      WHO PAYS FOR SHIPPING AND BEARS RISK OF LOSS?

      The customer is responsible for all shipping costs, including freight insurance for goods shipped to Seller. If Seller elects to repair or replace goods deemed to be within warranty, Seller shall pay shipping costs to customer, including freight insurance. If goods are deemed to be outside of Warranty they will be returned to the customer at the customer’s expense and at the customer’s own risk.

      MODIFICATION TO HARDWARE AND SOFTWARE

      Seller reserves the right to make modifications to both hardware and software without prior notification.

      COUNTERFEIT MODULES

      Seller will not repair or replace any product that is determined as not manufactured by Seller (counterfeit modules).

      BUYERS REMEDY

      For any claim made under Warranty, customer’s exclusive remedy shall be limited, at the Seller’s election, to repair or replace the defective Products, or refund of the purchase price (less depreciation to be determined based on the age of the product at the time remedy is sought), or credit of the same against future purchases by the customer at the mean market purchase price.

       

      NON-ASSIGNABILITY OF WARRANTY

      THIS WARRANTY IS THE ONLY WARRANTY MADE BY SELLER WITH RESPECT TO THE PRODUCTS.  THERE ARE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND BY THE SELLER OR ANY PERSON WHO IS AN AGENT, EMPLOYEE, OR OTHER REPRESENTATIVE OF SELLER, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONDITION OR PERFORMANCE OF THE PRODUCTS, INCLUDING BUT NOT LIMITED TO THEIR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
